Memo To:      Employers

From:      Margie Pascoe, Foreign Student Advisor

Re:      Canadian Student Employment

The purpose of this memo is to clarify off-campus employment eligibility and opportunities for international Canadian students attending and graduating from Montana Tech.

International Canadian students who have not graduated are eligible to work off campus in a category defined by the United States Citizenship and Immigration Services (USCIS) as curricular practical training. To be considered for curricular practical training, the work must be related to the students major and the student must receive academic credit.  Academic credit for curricular practical training is handled through Montana Tech’s Career Services Office.  In order for students to be eligible to apply, they must:

  • Be in lawful F-1 status
  • Have been a full-time student for at least nine months.

Students who meet eligibility requirements, register for internship credit and properly apply for curricular practical training will have their SEVIS Form I-20 authorized by me indicating employment eligibility verification.

Canadian students, who graduate with an engineering degree, are eligible to work in the United States under the North American Free Trade Agreement (NAFTA).  Canadians seeking authorization to work under the NAFTA Agreement must do the following: (1) Apply for admission through an immigration officer at the U.S. Class A Port of Entry.  (2) Show proof of Canadian citizenship.  (3) Show proof of an employment offer from a U.S. company, which documents the specific job and duties, salary, anticipated length of employment, educational qualifications or appropriate credentials that demonstrate professional-level status, and compliance with applicable state laws and licensing requirements for the position.  (4) Present letters of recommendation.  (5) Show proof of at least a baccalaureate degree or other credentials that demonstrate professional level status ... Engineering is listed as an eligible profession.  (6) Pay a $56 application fee.  Visit http://travel.state.gov/visa/temp/types/types_1274.html  for in depth details.  Visit http://uscis.gov/graphics/shared/lawenfor/bmgmt/inspect/nafta2.htm click on NAFTA Handbook.  Immigration inspectors use this handbook as a reference when processing applicants for admission as non-immigrants under the North American Free Trade Agreement.

Curricular practical training and the NAFTA classification are the two most common categories for Montana Tech Canadian students seeking authorization to work off campus.  I work closely with this application and authorization process and would be happy to answer questions and assist our students with employment opportunities.
